Administration is a procedure which places a company under the control of an insolvency practitioner and the protection of the Court. While a company is in administration creditors are prevented from taking any legal recovery action against it, except with the permission of the Court.
An administrator is usually appointed by a Company’s directors, or a lender with security, typically a bank. Administration is a very useful tool when there is the prospect of the preservation of a business, or part of it, as a going concern, as it can provide for a rapid and seamless transfer of the business.
